Abstract
The constitutional and legal configuration of education in Cuba, based on its exclusive and exclusive provision by the State, and the incontrovertibleness of administrative decisions in this area, is more oriented towards a sovereign public function of the State than to a public service in the legal technical sense of the term. The lack of guarantees, such as the direct effectiveness and linkage of all public "powers", the reservation of law, the legislative unavailability for regression, the essential or untouchable content, and effective judicial protection constitute serious limitations to consider education in Cuba as a fundamental right. This legislative situation may place right holders in positions of protection against possible violations arising from administrative arbitrariness or legislative setbacks.
